Clientele Agreement to Terms and Conditions

Clienteles agree to be bound by these terms when they agree to any service and/or transaction with Doctor Phone. In this agreement “you”, “your”, and “Clientele” refer to the person requesting any service or transaction with Doctor Phone.

WE RESERVE THE RIGHT TO REFUSE BUSINESS TO ANYONE FOR ANY REASON. If we believe that you have misrepresented yourself in any way that could be harmful to Doctor Phone, our customers, or the public in general we reserve the right to terminate our business with you and return your device in whatever state it may be in.

These are the Terms and Conditions which you, the customer, agree to and are applicable to the repair of your device by Doctor Phone:

  1. Doctor Phone will repair your device for the agreed upon price as indicated prior to inspection and repair. If after a full inspection, more damage is found on the device, the original agreed upon contract may be rendered null and void, at the sole discretion of Doctor Phone. In such instance, new agreement will be needed before any more work will be completed. Doctor Phone is responsible for the repair of the problem agreed, and no other issues will be addressed unless agreed by Doctor Phone and Customer. Doctor Phone may subcontract with other repair providers for the repair of your device.

  2. Upon full payment, the replacement part used during the repair becomes property of the customer. The replaced part becomes property of Doctor Phone. Doctor Phone has the right to not offer any refund for any completed service. Doctor Phone accepts no responsibility for working on notably lost or stolen devices. The Customer takes full responsibility for the status of the device brought in for repair.

  3. Devices seldom, regrettably, die in our hands. Devices are as diverse as the customers that bring them to us. We have no way to tell how well or poorly a device has been treated before we see them. If a device stops functioning in the course of the repair, we will inform the customer immediately. In-depth mother/main/logic board damage is difficult to repair in the best of situations and consumes a lot of labor hours. To better serve our customers, if the repair would exceed the cost of replacement, we will stop. Doctor Phone takes no responsibility, expressed or implied, in these situations.

  4. If you have not claimed your device and paid all charges due within thirty (30) days after being notified by Doctor Phone that your device has been repaired, Doctor Phone will consider your device abandoned, and may dispose your device at its discretion.

  5. If repair service involves transferring information or installing software you represent that you have the legal right to copy the information and agree to the terms of the software license, and you authorize Doctor Phone to transfer the information and accept such terms on your behalf in performing the service. You warrant that the repair service, if it involves transferring information or installing software, will not violate any software license. You agree to reimburse, indemnify, hold harmless and defend at your expense (or to pay attorneys’ fees incurred by Doctor Phone) Doctor Phone from and against any and all loss, discharge, expense or claim which Doctor Phone may suffer or be in any way subjected to on account of any claim or infringement of patents, copyrights, trademarks or violation of software license related to its repair service.

  6. Doctor Phone agrees to hold all data received from customer’s device private and confidential and agrees not to (a) disclose the Confidential Information received from the device to any third party; or (b) use the Confidential Information for purposes outside the scope of this agreement, except that we may disclose Confidential Information to the extent required by legal process.

  7. Software modifications or changes to a stock operating system not approved by the manufacturer or carrier of the phone will void any warranty covered or carried by the device/customer. Doctor Phone does not support or promote the use of pirating applications via software modifications. We are in no way, shape or form affiliated in illegal customer usage (piracy) or modifications stemming from prior jailbreaking/rooting services or the services we provide(d). Doctor Phone is not liable for damages caused or information lost due to software modifications or changes to a stock operating system. Due to the instability of software modifications or changes to a stock operating system, there is no warranty, whether expressed or implied, on any repairs that include software modifications or changes to a stock operating system. Services rendered by Doctor Phone may void the manufacturer or other warranties on the device. Doctor Phone does not assume any liability in the event that the manufacturer’s warranty is void. Customer agrees not to take any legal action in any forum against Doctor Phone and these terms shall act as a full and complete release and as an affirmative Covenant not to sue.

  8. Due to the unpredictable nature of liquid with electronics, there is a chance that your water damaged device may not be able to power up after the chemical cleaning process. We are not responsible for any damage from any attempt of liquid damage repair. We recommend that you back up all information stored on the device being repaired for safekeeping. Doctor Phone is not responsible for data loss which may occur as a result of the device being repaired.

  9. I understand that Doctor Phone reserves the right to take a 50% deposit of the total repair cost if a part must be ordered. The deposit is non-refundable unless a technician from Doctor Phone deems the device to be unrepairable. Customers acknowledge that after Doctor Phone makes initial contact to inform the customer that the part has arrived, Customer have ten (10) days to bring the device in for repair. After ten (10) days the part can be returned, and the deposit will be forfeited to Doctor Phone.
